Terms of Service

Please read these Terms of Service ("Terms") carefully before using MyFlightHQ (the "Service"), operated by MyFlightHQ ("us", "we", or "our").

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.

Who You Are Dealing With

MyFlightHQ is software licensed to flight schools. If you are a student, renter, instructor, or staff member, you use the Service through the flight school you belong to (your "School"). Three things follow from that:

• Your School — not MyFlightHQ — provides your flight training, operates its aircraft, and is responsible for your instruction and safety.
• Your School controls its own records in the Service, including your account, bookings, flight records, and balances. It decides who on its staff may view or change them.
• Questions about a booking, an invoice, a flight record, or your training are between you and your School. Write to us only about the Service itself.

If you are a flight school, you are responsible for the accuracy of the records you keep in the Service, for the accounts you create, and for how your staff use it.

Accounts

When you create an account with us, you must provide us information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.

Your account is identified by your mobile number, and you are responsible for activity that happens under it. Tell your School promptly if you believe someone else has access to it.

SMS Notifications

As part of the service, you will receive transactional SMS notifications related to your flight training schedule. By creating an account and providing your mobile number, you consent to receive these messages. You may opt out at any time by replying STOP to any message. Message and data rates may apply.

Payments

Where your School accepts payment through the Service, that payment is made to your School, not to MyFlightHQ. Your School sets its own rates and its own refund and cancellation policy, and receives the funds directly. Requests for a refund, a correction to a charge, or a disputed amount go to your School.

Flight and Maintenance Records

The Service helps your School record flight times, meter readings, squawks, and maintenance intervals. These records depend on what people enter, and the Service is a record-keeping aid — not a substitute for your School's own airworthiness determinations, required inspections, or regulatory recordkeeping. Your School remains responsible for compliance with applicable aviation regulations.

Acceptable Use

You agree not to interfere with or disrupt the Service, attempt to access accounts, schools, or data that are not yours, or use the Service to break the law.

Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of MyFlightHQ and its licensors. The records your School enters remain your School's.

Limitation Of Liability

In no event shall MyFlightHQ, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

Governing Law

These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
